SALES CONTRACT

On______________, Deb Bach of Bach Shelties agrees to sell to _________________________________________ the following Shetland Sheepdog described as:

The dog described above is guaranteed to be free of any health or temperament irregularities for the first 48 hours. It is recommended that the buyer have the dog examined by a licensed veterinarian during this time period. In the event the above described dog/puppy is acquired on a weekend, the guarantee time begins at 9:00am on Monday following the date of purchase. IF YOU DO NOT abide by this clause, no replacement dog/puppy will be provided to you, should the above described dog be currently ill.

HEREDITARY DEFFECTS: No expense for any TESTING will be the responsibility of the seller, unless other arrangements are made in writing.

SHOW OR BREEDING GUARANTEES: Unless arrangements are made in writing, this show or breeding prospect WILL NOT BE GUARANTEED. (eyes, hips, thyroid, VWD, size, bite, reproduction, etc)

REPLACEMENT: The seller reserves the right to obtain a second opinion or additional test at the sellers expense. If a second opinion is needed seller reserves the right to take the dog for further testing at their choice of veterinarians. This dog shall be returned to seller before a replacement shall be made. If replacement is necessary, the buyer shall be entitled to a replacement of similar quality when one becomes available. If a replacement of higher  quality is desired, the buyer shall pay the difference between the purchase price and the price of the second (replacement) dog/puppy. All payments  and terms of this contract must be met before this dog will be replaced.

FIRST RIGHT OF REFUSAL: Seller shall have the first option to purchase this dog back if the new owner decides to offer this dog for sale at any time.

REGISTRATION PAPERS: Seller shall hold registration papers until all of the purchase price is paid in full. Seller shall remain on registration as CO-Owner (after purchase price is paid in full) until any puppies owed back are received with registration papers.

PUPPIES BACK: This contract shall NOT include puppies back to seller unless placed in writing. The litter shall be made available for the seller examination at 8 weeks of age. Pick puppies shall be chosen by seller the age of 10 weeks. Puppies shall be given wormer and 1^st shots and are the responsibility of buyer.

PICK PUPPIES BACK: The buyer agrees to give back the following puppies from litters as listed here in this contract to the seller.

STUD RIGHTS: Seller reserves the right to 2 (two) free stud services to bitches of sellers choice.  Unless other arrangements are made herein:________________________________________________________

SIRES OF LITTERS for puppies back shall be of mutual agreement unless otherwise stated here in this contract.

NAMING OF ABOVE DOG: The dog purchased shall be registered with the BACH kennel name in front of it’s registered name, if applicable, unless otherwise agreed upon in writing. Seller shall have the right to choose the name and to send in the registration of puppy. The buyers kennel name may be added at seller’s discretion.

ALL GUARANTEES VOID: If the buyer breeds this dog, the buyer shall give up any options that may be exist per this contract for it’s return to the seller. Guarantees are void if there are signs of neglect or abuse on the part of the buyer. Guarantees for reproduction of a bitch are void if the buyer chooses not to prove the bitch before the age of  four years old.
Both buyer and seller have read the above contract and understand and agree to all the conditions stated herein. Buyer also acknowledges receiving a signed copy of this contract. This contract is legal  and binding.
